I had to suspend my holiday break to respond to this urgent issue. The Dept of Justice sneakily invites public comment on the “Criminal Law (Sexual Offences and Related Matters) Amendment Bill 2022” during the holiday season to deliberately undermine the public participation process.
The Bill will repeal the laws that criminalise the buying and selling of adult sexual services. This means the entire sex-industry in South Africa will be decriminalised – providing pimps, brothel owners and criminal syndicates who prey on the weak and vulnerable – the best gift ever.
Family Policy Institute (FPI) submits arguments to support the fact that a decriminalised sex industry is the worst possible policy for SA. We make this submission in consideration of the dire social realities in the nation and the warnings of policy failures on prostitution globally.
International studies reveal the policy of decriminalised or legalised prostitution failed wherever it was implemented. Instead of protecting the human rights and dignity of women trapped in the sex trade, decriminalised prostitution had the exact opposite effect. Decriminalised adult prostitution increases child prostitution. Research indicate the links between prostitution and organised crime are never broken regardless of the legal status of the sex-industry.
A decriminalised sex industry also significantly expands prostitution rather than contain it – luring many more vulnerable women and children into a life of unspeakable sexual exploitation, abuse and misery. Despite the failures of decriminalised prostitution internationally, the ANC regime supports this socially destructive policy to the detriment of the most vulnerable citizens.
“The National Centre On Sexual Exploitation” says, “decriminalization of prostitution is one of the world’s most disastrous approaches to the sex trade because it is a gift to pimps and sex buyers allowing them to carry out their activities as mere “sex business operators” and “customers,” and normalizes the sexual violence and exploitation inherent to prostitution as a form of “work.”
If passed, government’s support of decriminalised prostitution will undermine the human rights of persons trapped in the sex trade (the majority of whom are females), and grant impunity to perpetrators of sexual exploitation and abuse of vulnerable women and children.
South African society suffers high rates of sexual exploitation and abuse of women and children. Domestic abuse of women and children are also at intolerably high rates. Considering these appalling facts against the backdrop of soaring rates of unemployment and endemic poverty renders decriminalised prostitution illogical, unsustainable and untenable in South Africa.

The ANC government has legitimised the buying and selling of women as “sex work.” However, Julie Bindel exposes this destructive lie in her article, “Abolishing the Sex Work Myth.”
Incredibly, the Dept of Justice ignored the recommendations in the SA Law Reform Commission’s Final Report on Prostitution Law Reform. The SALRC conducted a comprehensive 9 year investigation into prostitution (commissioned by the same Justice Dept) and warned against decriminalising prostitution because of the high rates of GBV, poverty and unemployment.
The ANC regime has chosen to surrender South Africa’s social policies to UN agencies and other sexual rights radicals to the detriment of the safety and dignity of women and children.
Please make your voice heard on this disastrous Bill that seeks to fully decriminalise the inherently abusive sex industry in SA. We must reject state-sanctioned sexual slavery to protect thousands of vulnerable women and children from a life of sexual exploitation and misery.
