Things are heating up on the legislative front. The foreign-funded “Sex Workers Education & Advocacy Taskforce” (SWEAT) is attempting to circumvent the democratic legislative process by asking the High Court to declare unconstitutional the laws that criminalise the sale and purchase of sexual services, thereby decriminalizing the entire sex-industry in SA.

The “Sexual Offences Amendment Bill” that will legalize prostitution in SA hit a roadblock in Parliament recently when State legal advisors warned the Department of Justice that legalizing the entire sex-industry without any regulations may be declared unconstitutional.

Family Policy Institute (FPI) and a coalition of organisations working to rescue women from the sex-slave trade are hoping to join as amicus curiae to oppose this application. However, FPI must urgently raise the necessary finances to fund this critical endeavour.

In addition to the foreign-funded agenda to legalize prostitution in SA, the “Basic Education Laws Amendment” (BELA) Bill grants State officials extraordinary powers to override the authority of parents and School Governing Bodies in the educational choices of children.

Significantly, however, the DA Minister of Basic Education, Siviwe Gwarube has requested President Ramaphosa not sign the Bill into law but send it back to Parliament so it can evaluate the tens of thousands of public submissions ignored by the ANC Regime.

But Ramaphosa is under intense pressure to sign the Bill from within the ANC, SA Democratic Teachers Union (SADTU) and COSATU. The BELA Bill favors the corrupt.

Former ACDP MP, and Portfolio Committee on Basic Education member, Marie Suker wrote President Ramaphosa a Letter urging him not to sign the BELA Bill. She outlined a litany of serious procedural and substantive flaws that may render the Bill unconstitutional.

If Ramaphosa ignores the pleas of Gwarube and Suker, FPI will act as second applicant in a High Court case challenging the constitutionality of the BELA Bill. Opposing the SWEAT – and the anticipated BELA Bill cases – means FPI must urgently increase its funding levels.

The Gauteng High Court dealt the National Health Insurance (NHI) Act a serious blow when it recently ruled parts of the scheme are unconstitutional. There are several legal challenges against the unaffordable NHI system that may torpedo the entire scheme.

We are also monitoring the “Single Marriage Bill” that seeks to redefine man, woman marriage in law. FPI will mobilize citizens to defeat the agenda to abolish the unique definition of man, woman marriage to equate it with same-sex and transgender unions.
