In this crucial segment of the FOR SA Virtual Roadshow, we unpack the controversial Hate Speech Act, signed into law in May 2024. Although not yet in force, this legislation creates a new crime of hate speech — punishable by fines or imprisonment of up to five years — and poses a serious threat to constitutionally protected freedoms, particularly religious expression. With vague and overbroad definitions of “hate” and “harm,” the Act risks criminalising speech that is lawful, peaceful, and based on sincere religious beliefs.

FOR SA explains why the law fails to meet international free speech standards, why the so-called religious exemption is practically ineffective, and outlines three possible responses — including FOR SA’s preferred route: advocating for an Amendment Bill to correct the Act’s most dangerous flaws.

This video also emphasises the power and necessity of meaningful public participation in shaping laws that affect all South Africans.

  1. In the video we have a religious organization that says ‘we’re against many people’…. That’s a little concerning isn’t it? It’s like you’re asking exemption to day hateful things.
